German cabinet to approved third gender option on identification card

News24xx.com - The German cabinet approved a regulation that would add the third gender option to the official identification card, Wednesday, August 15th 2018. The law, which will enact this year, allows intersexuals to register their gender as "different" or "other."

Until now, people with such conditions can only register themselves as gender-free. This draft law follows the ruling of Constitutional Court last year which argued that the current system violates a person's individual rights and antidiscrimination laws.

The court ruled this based on a case in which a plaintiff had only one X chromosome, without a second sex chromosome. The plaintiff at that time wanted to change their gender on the birth certificate from "female" to the third category, but it did not work.

As is known, women have two X chromosomes, while men have one X and Y chromosome. The judges argue that the authorities must choose not to include gender identification at all in the identity card or allow people in the same situation to choose "type sex that is not male or female."

Justice Minister, Katarina Barley from SPD party also welcomed the draft bill. He said "even though it was too late, we finally modernized Personal Statute Act" and "no one may be discriminated against because of their sexual identity."
